Injuries to Children
Parents always state the worst thing that could happen to them is the death or serious injury of their children. One of the worst cases I have ever experienced was two girls, six and seven, playing in their front yard when a car swerved out of control and killed them. The driver had no insurance and the kids did not have any uninsured motorist coverage.
Under Alabama law, children are afforded special rights.
For example, children under the age of seven years cannot be guilty of “contributory negligence” which is a doctrine used by insurance companies to deny victims compensation. Children between seven and fourteen are presumed not to be negligent unless the insurance company can prove that the child had the discretion, intelligence, and sensitivity to danger which an ordinary child of fourteen possesses.
Likewise, a child cannot be denied recovery if their parent is negligent. This is another tactic used by insurance companies to deny compensation to a child.
